I think if the judge agrees, and PD finds weapons, they are impounded. Not sure if the owner is taken in
As to jilted people, the judge will typically issue some contempt if you waste his time with trivial snide complaints The guy in Santa Barbara the cops came by but didn't go into his house to search his room |

IIRC, a judge still has to see and grant the approval to search/remove the weapons. The evidence presented is designed to be enough to get past the well-rounded person answering the door.
