I have a quick lawyer question....so if he wins this case and the court rules in his favor, is he left with the bill or can he counter sue so that she has to pay his lawyer fee?
It's kind of ridiculous that people do this without proof, knowing that all their causing you is a headache, but then are you still stuck with the bill in the end? |

From what I understand is I would have to sue her in civil court... which would take forever to recover $30k from a 22 year old girl. But I will take it all the way. |

not only would it take forever.but more likely then not she wouldnt be able to afford to pay you that money thus she would either liquidate her current assets or declare bankruptcy which also means add about 10 years onto that and youll get pennies on the dollar.

I don't know if this is right, but if all the facts are true, then why not keep her in court for the longest time possible? If she's after moeny then bury her in legal fees...reappeal the case, counter sue her under defamation, etc. until you run her into the ground with debt...

I am sure this is not clean cut as what he is saying. If the DA is going through all this they must be having some thing good. I am sorry if you commit a crime you have to pay the price. |

I don't see how an entire city can be on her side, as it doesn't sound like a public case to me. |

Its a criminal offense, thus the district attorney (DA) is the lawyer for her side, but there isnt a her side its the city/state who is prosecuting him.

That's probably why we have to fight traffic tickets to prove we are innocent in court. Having said that, since the OPs case is in criminal court, it has to be proven beyond DOUBT that he's guilty to receive any punishment. Its ok to let a 1000 criminals walk, but its not ok to let even 1 innocent suffer punishment. That's what this great country stands for... mark of freedom. |
