*rant* stupid tenants
How many of you guys own rental properties? I'm so freaking pissed off right now.
One of my freaking dumbass tenant called me a while back and told me there are repairs that needs to be done, and I said ok... we'll send someone over. For 2-3x the repair man went over, but the freakin tenant won't open the doors for my repair guy(there were people in the house). Now the f**king tenant won't pay me rent and wants to sue me for not doing any repairs. WTF? Another tenant called me about 2 weeks ago saying that her washer doesn't work. So I went to bestbuy and ordered her a new one. Bestbuy tried 3 delievery attempts, but no one was freaking at home to sign for it even though I told the tenants the time frame for the delievery. Again, freaking tenant won't pay rent and threaten to take me to court. Great way to start a new year isn't it. :mad:

if you have all your paperwork about ordering the washer and having the repair guys booked for that day, i'd first throw those tenants out of the apartments, call the police since they refused to pay your rent, and then encourage them to sue you. there is absolutely no way they'd win, if you have all your papers in order.

I'm not worrying about going to court, because I know I will win. The part that got me pissed off is that these people will try to do anything to avoid paying rent... Fine, even if you are not planning on not paying rent and actually wants the repairs done then open your freaking door! If you want your freaking washer, then stay at home and sign for it! I mean how stupid can they get?

I'm not sure about residential tenancy laws in the US (or your state), but in most places witholding rent from an owner is illegal and in breach of contract (even if it's because required maintenance has not been carried out). The tenant has every right to bring the maintenance matter to a tribunal/court but they must still pay the rent in full and on time.
It seems as though you've taken all the necessary steps to effect the repairs of the premises, but the tenants are too bloody-minded/stupid to realise. If you've got proof (work orders, receipts etc.) then the tenants really have no legal leg to stand on. As well, if they continue to withold rent, then you have every right to commence eviction proceedings as outlined by the contract and/or the tenancy laws in your state.

I have 7 rental properties. I treat my tenants as my clients. They are always right; I always try to do my best, I really care. If your E90 broke down you want BMW working on it fast. Tenants are the same. I've never had problems like this before. I've been a landlord since 1986.

I have 9 rental properties all together, and I treat my tenants as my clients as well. You get good tenants and bad tenants... Some of my tenants are excellent, and the others is just eek. But I would have to disagree with you that they're not always right. You're right on saying if my e90 broke down then I want bmw to fix it... But how are they going to fix it if I refuse to bring it in? It's the same thing with my situation. They're refusing to open the door to the repair man, and they're refusing to be home to sign the delievery papers. I believe I've done my best as a landlord. no?

My father is a real estate broker and owns a property management business. He can really tell you stories about tenants and things that they have done.
The question is what is the EXACT language in the rental agreement? You still own the property, not the tenant. If you give them due notice (in writing) that someone will need to have access to the property to perform repairs they MUST let them in (at least this in the contracts my father uses). They cannot refuse access to YOUR property. If they decide they don't want to pay rent.... As soon as they are thirty days late, file papers to evict them (again if this in the lease agreement). It's amazing how people change their stories when they realize you are not BS them and you will inforce the contract they signed to the full extent. FYI I in now way advocate being a bastard of a landlord to anyone, but respect is mutal. If you tenants do not respect your property then they do not deserve for you to cut them any slack... They are costing you money, doesn't sound like respect to me.

Damn, that sucks! I don't have any rental properties, but based on your story if I ever do I will have a clause in the lease agreement that will grant me the right to beat the tenant with a baseball bat at my discretion.
Actually a friend of mine just bought a duplex... Tenant 1: Family with stay at home mom that spends her days looking for things wrong with the apartment and spying on tenant 2. She was still in court with the previous owner for some unknown reason when my friend took ownership of the property. She has been piling snow in front of the garage all winter to spite the previous landlord. Tenant 2: Pays rent on time, and keeps to himself. Has guns prominantly displayed throughout his extremely sparsely furnished apartment (this is unusual in Canada). He has one room completely bare with nothing but 2 flood lights and a laptop computer. He apparently dates very young girls and wants to leave because tenant 1 has taken it upon herself to "gather evidence" about him. |

My dad put all the rental into the family trust, and I am the guardian for my generation, so I get to see all the BS with tenants. It's unfortunate, because a lot of people who live in rentals just have no spare income at all, so they will pinch that buffalo until it bleeds. My dad tries to be nice, but after a few late months, he lets them know the next time they will get a 3 day notice and be out. Luckily for him, he is an attorney, so filling out the paperwork can now be done in his sleep.
On the washer delivery, did you ask the tenant when was a good time to deliver the item? Some of them do not have the luxury of sitting around the house waiting for a delivery guy who is supposed to arrive between noon and 4, they need to be at work to make the money to pay you your rent on time. What really gets me about rental units is just HOW the people live there. I know, it's not theirs, so there is no pride of ownership. But come on, you still have to LIVE there. There's mold growing halfway up the window, the floor is sinking and rotting since you didn;t call about the leak under the sink, and there are WEEKS of trash with $#itty DIAPERS in it!!!! I've been a material witness on discussions of the return of deposits after damages were repaired. I think I've been summoned 3 times. And each time I've only had to say 3 words, once each time, "Yes, your honor." |
