I went to my gf's apartment and was there a few hours early before she got off work. (she lives an hour away...under estimated LA traffic)
Instead of just wondering around the city I went to my gf's apartment and her roommate (the accuser) was home alone. I hung out there for 2 hours (watched tv, talked to the roommate and slept). When I woke up I went to my gf's work to pick her up and I waited outside for her to get off...

While i waited there a 3rd roommate came yelling saying they called the cops etc... I drove around and came back to the apartment trying to figure out what was going on and settle whatever issue there was. And i was cuffed. No questions asked, other than if I had a gun or a bomb (happened on sept 11th)

He story has its flaws, the night of the so called crime. She told the cops I touched her vagina, a few days later when they questioned her again, she said I tried to touch her vagina. She also called me the following day after my arrest asking me to call my GF...

my gf is still living with her roommates because of the lease agreement... but their all set to move out the end of this month when I goto trial.

Another thing to add... my family had contacted this chicks family the day I was bailed out. They had come to an agreement for me to pay a few grand to the girl. The next day we were supposed to goto a notary to sign some papers but then they bailed out.

Take a simple tape recorder, meet up with her. Offer her $5grand cash to drop the charges and make sure to say "Both you and I know what you accused me of is false and your only trying to get back at me so just take the money and call it a day". Have the $5k cash show her let her take it, then go to the DA and have the DA put out a warrant for her arrest for making a false report, then go to civil court and sue her ass for $5k back plus damages.

Its the prosecutors (DA) job to prove guilt here. Meaning they have the burden of proof. A method sometimes used is; Since they go first in the trial if after the people rest you and your lawyer feels as if they didn't prove your guilt, you can skip your whole defense and have a motion for directed verdict.

Just one more piece of information for you, if this is a criminal case, which I believe from what I read it is, the girl really has no control whether or not to press charges, that lies with the state. She is merely the complaining witness and if she chooses not to testify can be thrown in jail for obstruction.

Good luck bro, sometimes the Court system can be a PITA but if you understand it and your lawyer is telling you everything it should ease some of the tension. Has the trial started yet? If not your best bet might be to make some type of plea; No jail time-you do not have to list as a sex offender-but you do some time of community service. Not sure what the law in CA is like or penalties for these crimes (or alleged) are like.

They do this to prevent any further damages you COULD do to the female after the popos leave (which will allow the female to sue the cops and the city) but you are innocent until proven guilty in the sense that you have the right to be bailed out (which is a unfair and unjust system in itself)

You all have to stop saying he can just pay her to stop...even if she were to accept it she has no say in this. Its a criminal trail meaning its the State (DA) vs a 3rd party (SfValley) He/she has no say whether or not the charges will be dropped. If the DA feels they have enough evidence to prosecute they will. As i told him before, she could accept the money and not testify and they will threaten her with obstruction of justice/im sure they have a signed affidavit by her telling exactly what happened so if she tries to lie on the stand (and by lie I mean not stick to her original story, I dont know who is telling the truth here) it will only make her look bad and be tried for perjury later unless she rectifies the matter.

Again SFValley, I suggest you talk to your attorney about a plea, like I suggested before, maybe if you can plea down to a Class 2 Misdemeanor (up to 6 months in jail) and or a $1000 fine. Try to get the DA to agree to 1-3 months and the fine and where you dont have to register as a SO, which would ruin your career and basically your life (sorry to put it so blunt). Who knows if they would accept it, they could have what they feel to be a rock solid case in which you would need to pray, and if you are of Middle Eastern descent hope your ATTY got some minorities on the jury and pray the rest arent racist SOB's.

But I will remind you and everyone else reading this again, its the DA's job to prove your guilt, and they must prove it beyond a reasonable doubt.

I have alot of female friends and from what i noticed, whenever they feel guilty of their actions from the previous night, they say that the guy "forced" them into it. Then again, there are guys who take advantage of a women who is totally passed out.

gluck with your case. If theres no evidence, you have a good chance of being off the hook regardless of what happened. It will be stressful moments until the court day (and this day you will be shitting in your pants).

With that being said, if the case makes it to court, that means there was some form of evidence to prosecute the case.

Questions like
Was alochol/drug present?
A weapon?
Bruising?
Semen?
Witnesses?


will all come into play if yes to any of them.
