A junk yard or scrap yard will not take a car without a title.
For her to do the transfer of title to her name in CA, she will have to pay all the fees and sales tax. That might be close to $1000. As she is not a 'dealer' you can not just put your name on the title as being sold to you without her having it in her name first. I can't imagine a dealer selling a car and not doing the title and transfer right then and there. Until the title is transferred, the dealer still owns the car and is liable. It might seem like a 'free' car to you but it will be a huge headache and risk for you. Walk away from the free car that was not titled into her name and in California's eyes is not the owner to be able to give it away. Be smart, be safe and do the right thing and stay out of jail and drop the car off at her family's house, give them the keys and tell them she said that she will come to pick it up next week and turn around and walk away. Or go park it on the street with the keys in it and let someone steal it and rob a bank or kill someone in an accident with it and get caught on video and she gets arrested as owner of the car. Bummer. |

Promise I'm not a mod in disguise! I just didnt really know where to post this. Reddit is a hit or miss but I figured car-inclined people would have better insight into this realm of things.
Thanks everyone for this advice! I'm going to try and pursue this legally for the time being and just keep it parked behind my new house. I really really doubt that this person would try to come back and screw me over, we were really good friends and I think this is just a really odd situation - again, no skin off my back if you really think about it. Just kind of inconvenient, but hey - I may score a free car out of it. So we'll see. I'll update this thread when something develops. Until then... the 328i will slumber |

Few things with title: If title is in dealership name and she never took it in to get the title in her name (usually means going to DMV and paying taxes), then car will still show registered to the dealership or whoever was on that title. Now, that would be really stupid dealership in my opinion. Not much you can do at this point unless you get the title in your name. I guess you can drive the car with your civic plates (and if pulled over say you are transferring plates), but if an accident or something like that happens that might get complicated. Most likely you can get insurance as they never check. Or if the car get's towed, you will not be able to get it back as you are not the owner. You can also, part this car out, get another 328 and transfer parts, or just drive it until wheels fall off and dump it, or maybe make it into track car. Either way, as much as a freebie sounds nice, remember it can be gone any second, by getting it towed, or by your "nice" friend reporting it stolen or something. |

Buy a plane ticket, visit said friend, get her to sign the title over in person. Net gain: 7500

So send her the title to it with a letter explaining your going to have to
start charging her storage. And you need the new title, signed off by her, to sell it per her instructions. Send it certified mail with return receipt. Go to police station and discuss issue with Sgt or Lt. Write it all down, to include their names. Verify thru your Dept of Vehicles and follow instructions. They don't need her title to obtain another "clear" title. Jump thru their hoop . . . NOT hers ! Follow instructions, and you will probably end up with the vehicle. A well used BMW driven by someone who paid no attention to it. Myself I wouldn't even roll the dice IF i should keep it . . . its GONE ! ! Take the money and buy . . . another CIVIC. That BMW will be a BLACK HOLE !

@The Wind Breezes fortunately that is false. Maybe you skipped the part where she lives in California and I live in North Carolina? Lmao To answer all - no, I have not and will probably not fuck her. She is in the adult film industry - and that's all I'm going to say about her and her situation,. not risking a dox. I don't judge her, but I assume she is into recreational drugs. I know she used to have a Xanax problem (yeah...this pretty much explains it LOL) but I'm not sure about her condition now. I just know she makes obscene amounts of cash. Scout10 thanks, this is basically what the entire legal process is, that I'm starting on. I ended up getting a consultation with a local practice and they said it should be pretty straight forward, but I definitely need to send certified mail. The BMW will definitely be a money sink in the future but for the time being it doesn't need major work so that it the defining factor. The Civic, were I to get it re-inspected, needs at least $800 in tranny work (ie, buy a new fucking tranny) and maybe another $1000 in misc shit (shocks, brakes, tires)... the care isn't worth $1200 so I'm finding it hard to throw enough for a downpayment on a used car to fix the civic. Thankfully for the time being I don't really need a car and my girlfriend has hers. |

Dropping it off at her family's house is the worst idea! That's like winning the lottery, then saying "Ah, it's too much work to sign the back of the ticket and send it to the lottery commission, so I'm just going to give it back to the store". It's an ABANDONED CAR that has been in your possession for MONTHS. There are legal ways to make it LEGALLY yours.
