Evito, she was a sitting judge for 10 years in NY's criminal court.
No need to explain? She's still innocent until the case is over and proven guilty. She deserves to provide an explanation to defend herself even if it's "clear" to you she's guilty.

A guy holding a knife while he stands beside a guy just got stabbed might seem very "clear" to you he's the murder, but a trial is still necessary. There can be so many explanations to why the guy was there holding a knife. I'm sure you get what I mean.

I can accept Judge Judy yelling and all that after she's proven guilty, but I cannot accept her taking away all the rights the scammer deserves to defend herself.

Tell me it has not sunk into your head that this is a show and I won't beat a dead horse for you. It's not real court. The participants are at the mercy of the show's producer and host. I've sat in real court on many cases, and I can tell you if the judge wants to berate those they consider scumbags, they can. One's attestment or opinion to someone's character is not all that relevent to their innocense or guilt, let alone a justice of the court who is pretty much free to have opinions on the plaintiff and defendant without much reprecussion. We call that the theology of law. The SCUMBAG scammer put herself in that position when she SIGNED a CONTRACT and RELEASE to come on the show. I don't understand why you're still fighting for her when she willfully participated on a show. PEOPLE CAN SIGN AWAY THEIR RIGHTS. Please don't compare an attempted murder to an accomplished fraud. Completely different scenarios, outcome, violation of law and motivations. In short, it's false analogy.

The part about the weight being like 5 oz. is a very strong point, but I always thought one should still be innocent until proven guilty. It seems like Judge Judy, with her years of experience, was able to tell the scammer is guilty at the first second the scammer stepped in the court.

I know it's a TV show, but I just hate it when people just bash on the bad guy and never even let him explain.
did you even watch the vid? The fat lady claimed that what was in the picture was what was being sold. A "reasonable person" would interpret that to be the actual cellphones. The fat lady argues that she was selling just the picture, which is a ridiculous claim. That is clearly fraud and Judy didn't need to hear anymore from her. I would learn a little more about our legal system before you start analyzing this.

She was about to explain where in the contract that says explicitly only the pictures are for sale, but before she had the chance to do that, Judge Judy interrupted her and just started yelling. I'm not trying to argue she's not a scammer, but I won't jump to conclusions before the trial even started, which is what Judge Judy did. I'm simply arguing this whole time how Judge Judy quickly jumped to conclusions and used her "great amount of experience" to identify the fat lady to be a scammer before the trial even started. I believe anyone in this world has the right to explain themselves and should be considered innocent until proven guilty. Just listening to one side of the story and quickly go ape shit on the other person doesn't look too professional to me. Whether if it's clearly fraud to you, does not mean the fat lady loses all the rights to defend herself; this is why we have a trial, not a place for someone to get yelled at.

I have no rights or qualification to say if she's guilty or not and neither do any of you (assuming Judge Judy is not here). I'm just looking at the case as a whole, and present some evidence in the video that the majority of the people here seem to ignore. I see no point in responding to this thread anymore. Have fun...

Chinesedude or whatever, you've got to be a left-wing liberal. I'm so tired of this tolerant and "anything goes" attitude. With your logic I suppose terrorists and extremists should be given rights too. After all "innocient until proven guilty" right?

Ok so Judge Judy jumped to conclusions....So what? It still doesn't excuse the fact the fat bitch was a scammer and deserved to have the book thrown at her. $400 for a photo of a cellphone? On top of that the dumb bitch didn't even word her scam right so her whole argument is invalid. She doesn't even have a job, she would rather sit home and scam people out of their hard earned money. *High-five to Judge Judy*

People like this are scum and they deserve no sympathy.

Instead of trying to claim that she actually sent the plaintiff real cell phones instead of paper, she admitted fraud when she told the court that that she sent them paper because that is what her 'disclaimer' read.

A general legal definition of fraud is as follows:

'an intentional misrepresentation of material existing fact made by one person to another with knowledge of its falsity and for the purpose of inducing the other person to act, and upon which the other person relies with resulting injury or damage.'

This case fits this definition exactly. For better or for worse, our legal system is not completely black and white. Any reasonable person would believe that the advertisement was for real cell phones, not a piece of paper. Judge Judy is not a 'real' courtroom in the sense that there is a judge and jury. She is the appointed arbiter, whom alone holds the legal power to settle a dispute by passing legally binding judgement.

The moment that this woman admitted to fraud, Judge Judy jumped all over her. This is court TV in case you did not notice. Although court TV displays real cases with real settlements, it is intended for entertainment. This is why court TV exists. Judge Judy was both doing her job as an arbiter and doing her job as an entertainer.

She had all the facts (or at least alleged facts) that she needed in front of her in the form of plaintiff testimony and hard evidence. This evidence was substantiated when the defendant explained her side of the story, which clearly involved fraud in every sense of the word. Just because she disclaims the advertisement does not mean that it is not fraud.

The fact that the defendant was ignorant enough to believe that it was OK legally to do such a thing is why court TV exists today.

I can't believe that I am even arguing with you here. It is quite obvious that everything that happened was appropriate. No more from you about that, please. Especially about the part when you say that she should have the right to defend herself. Her 'defense' was in fact an admittance of guilt. Usually a defendant will attempt to disprove what the plaintiff alleges. The fat woman's only try at a real defense (which she said over and over) was that it was clearly written on the advertisement. Too bad for her this does not hold up in court when an obvious case of fraud is involved.

You are way off base here. You're mixing up civil and criminal court. JJ is a show, yes, but it's essentially binding mini-trial arbitration, staged to resemble a small claims (civil) court. It's not all that different than "real" small claims court, except the cases are more interesting and the judge has way more personality.

But it's not criminal court. "Innocent until proven guilty" applies to being charged with a crime by the government. In this case, the fat biatch was being sued for money, not jail time. The way it went down is how it would go down in real court, just with a little more drama for the cameras.
