Curious question to the vast majority that says that the OP's friend should let it go: What if there was a written memo circulated by Target management to its employees not to spend extra effort to firmly affix posters, signs, etc. because the time wasted in doing so could be better spent somewhere else?
The "let it go" position creates a moral/logical contradiction: 1) Logically, the existence of this memo shouldn't change your mind because you would never have known about it had you not pursued legal action (and hence underwent discovery). 2) Morally, shouldn't you change your mind because Target should pay for this behavior? Pursuing legal action doesn't always mean going for big $$. It is also used to effect change (e.g. Brown vs. Board of Education). |

Again, another instance where legal action can help force change that is beneficial to everyone. Edit: Cliff's notes (for the tldr folks): 1) Vehicle was not moving during spill. Cup was placed between thighs so as to remove cap to put in sugar and cream. 2) 3rd degree burns over 6% of body that required skin grafts (See radix's picture) 3) Sought $20K settlement, but McD refused. 4) Not the first time this has happened per McD's documentation. 5) Coffee held at 185 degrees per McD policy; typical coffee shop is 140 degrees. 6) 185 degrees causes 3rd degree burns in 2-7 seconds. 7) McD testified that it expected customers to go home first before consuming, even though it's own product research contradicted that. 8) Jury awarded $200K (reduced to $160K because woman was 20% at fault) in compensatory damages 9) $2.7M in punitive damages (or 2 days of McD coffee sales), reduced to $480K, even though court found McD callous, reckless and willful. I really hate the sue-happy mentality but if my face was permanently scarred for whatever reason I would be pissed and want some sort of compensation. If the scar was in any other place or my face healed reasonably quickly I wouldn't gaf

I tore my left MCL in DFW airport because the janitor had just mopped the floor in front of the door of the terminal shuttle and didn't put up a sign. As I was walking toward the shuttle my foot slipped on the wet floor, my body got turned at a weird angle, I felt and heard a pop in my knee, and game over. I didn't have to have surgery but I did end up visiting the ER, had follow up visits to an orthopedic surgeon, an MRI, x-rays, a brace, etc.
About a month after it happened I called a lawyer in TX to get his opinion on if it was worth pursuing. His first and last question was: did I have to pay for any of my medical expenses? The answer was no - everything was covered by worker's comp insurance as I was traveling for work. He said there was practically zero chance of getting any kind of settlement beyond covering medical expenses since it wasn't a permanently debilitating injury.
