OP, that video is disgusting. Seems like someone might have their priorities messed up.
But immiketoo makes a good point; it's hard to look at something like this without knowing a lot of the other facts surrounding the incident. |

No it doesn't mean you shouldn't ask for advice. It means it shouldn't be the first place you ask for advice. Everything you asked was answered with a simple file I posted in a different thread by a better spoken high school kid. A file that you can search for on Google. Or could have searched for within these forums that contain the wisdom you so desire. GL |

and this is why i agreed with peanuto, he obviously knows he was in the wrong but was saying the cop was a dbag, and he was being one end of story....cops have protocol to follow and he had nothing against him at the time bc he passed the field test(and refused a blow test) so the officer at the time had no reason for him to be arrested(hints why he kept saying he wasnt arrested), so he "detained him" until further notice, also probably the reason the judge let him off easy because they didnt have physical evidence he was driving under the influence, so he got PBJ...fuck im not even close to a lawyer or ever will be, but i can see that shit plain as day

If any of you guys are trying to be a Police Officer/work for DHS/any BLE, I suggest looking for a new profession; you won't pass the psych. Police officers/Agents/etc have to be passive yet assertive when the time is right. Many of you guys get so flurried when someone does not agree with you and start calling one another stupid, idiotic, etc. Listen to one another and have helpful comments and/or advice.

Surely they could have used other devices or something to detain the dog. I am an animal lover as well, but being in such a tense and aggressive situation that involves SWAT officers and not police, this obviously was a highly tense situation. The officers did what they had to. I completely agree with what imtoomike said earlier. Pitbulls are also a breed known for its courage and aggression. Were not talking about a yorkie or chiwawa. If I was in their position, I wouldn't let someones dog attack me either. How many of you would stand there and wait to see how predictable the dog is?
The only thing I saw wrong with the video was the fact the children were never removed from the house. Usually in the event that children are known to be in the home, they will have someone from child protection services there anyways. Cops were too occupied with the suspect.

They also shot a corgie... Now a 25 lb corgie is a terrifying thing...???? I agree with a pit bull being a serious potential threat, but not a corgie.

I believe it is now standard operating procedure to shot any dog in the house they initiated a raid on. The police will and do claim their lives' are at risk. The courts these days have given the police wide reaching discretion to protect themselves and if they feel they could be at risk they can violating your rights. If you do not believe just look up any number for recent state and federal case laws on the subject.
On the whole miranda rights discussion. Again I believe as long as they do not arrest you they do not have to mirandize you and they can ask you any questions they like and use anything you say to them at that point. The distinction is the actual arrest, they can detain you for a period of time without arresting you or filing charges against you. This is a little trick the police now use to their advantage, they will tell you your not under arrest and it will be better to answer their questions, keep in mind they can always arrest you later and then give you the warnings I would said this guy in the video did the right thing, he shut up did not answer their questions even his full name and ask for a lawyer. Notice when the second officer came up and asked him questions and the other officer told him he lawyer up the questions stopped and they put in him the patrol car. At that point the police could no longer ask him questions without anything he say being thrown out. Again, I believe the distinction is he asked for the lawyer, if he did not ask you know it would have gone a different way. |

BTW, I just read somewhere else the Pit Bull was in a cage when they shot him, not sure how accurate that is but, everyone is pretty much in agreement that dog should not have been shot, unless the dog came after the officer, kind of hard if it was in a cage.
