Hmmm imo you should pay him the $150, if there was really inner wear on the tire and you didnt see it or failed to mention it thats is definitely your bad. These are tires after all theyre something that is absolutely critical for a safe ride, so every little thing should be mentioned about them. Buying used tires or used tires on used wheels online is generally a bad idea cause without the proper tools you'll never be able to gauge realistic tread wear nor can you see the product in person. if it was 600 + shipping you will still net 450 out of the deal. "+ shipping" implies that the buyer paid for shipping in addition to the 600 he paid for the wheels.
Where did you sell the wheels anyway? I don't see a FS here.

Here's my opinion.
First off. 1. Communicate in email, have everything documented. Phone conversations are worthless (if this thing does drag on into court). 2. He's obviously unhappy. Did the tires really come w/ the inner wear? If so, imo he has a legit request to get a refund w/ the shipping. If the inner damage is not the dispute and the dispute is about the shipping, he wants to be done w/ the situation and in the end it not costing him anything. If this really went to court, it would probably go down to if you knowingly sold him something w/ inner wear that you knew about, or the terms of the sale (what if they were damaged in shipping, return policy, was the item described accurately, was anything deceptive, etc.) It sucks, but I say cut your loses and tell him this... email him in writing that you'll pay for x type of shipping and send him a check for it once you receive the wheels back. Don't front the shipping $. This way he has peace of mind in writing, and the situation is just done with. In the long run will the $150 be worth the headache? Ya... I've been watching People's Court during my lunch break the since January, haha.

Ok.. so basically, if we looked at it from a companies point of view, you sent the customer a defective product. In this case, the company should be able to exchange the product for a non-defect, HOWEVER, the customer must ship the product back to the supplier at his/ her own expense....
This was the exactly how it was when I worked for Dell Computers during the summer.. Dell sent him a broken keyboard and "cracked" monitor, he rampaged to the kiosk and demanded a refund, following protocol, I told him to send it back through a shipper of his choice (at his own expense of course). If he already filed a claim with Paypal or whatever, tell him to get bent as he filed a complaint without consenting with the seller first.. not even trying to negotiate.. Asking for $150 is not negotiating... I can't imagine how much more the inner tires are worn than the outer part..... Ask him for some pics and post them up.. so we can take a look at the tire wear and determine if its worth a $150 refund, or any at all... You offered full refund etc, hes the one thats making this a big deal... I hope the prick is reading this because your GAY! |

you misrepresented your item. You stated 90% tread. Why should the buyer pay 200 bucks to ship you something that you misrepresented. Paying him the 150 would be the best way to resolve this issue on both ends. If you believe that your wheels were worth 400 dollars with 90% tread, then 250 for wheels with no tires (useless tires are as good as none) seems fair.
I still think this situation is BS

You can even ask him if he wanted a refund, you will send him money so he can ship it back.. If shipping was $200, I'd say $100 each is fair.....
