Person parked beside me scratched and hit my car without telling me. What do I do?

I don't have proof but today my car has a dent in it and a big Scratch across the whole car. the person beside me has a big dent in there front bumper and you can tell it's cause they hit my car. It's a parking garage and I don't have proof, I took a picture of there license plate and the damage to both cars. Do I file a insurance claim? Would my insurance go up because I don't have proof. Do I file a police report?

would that person get charged for a it and run

Wow, I'd generally say there is no way that person didn't know they hit your car, but the fact they remained parked next to you has me thinking this person might be completely clueless. That's some pretty big damage for a parking lot incident, I have to imagine if the person who hit you actually knew they would have pulled out of the spot and parked far away. I don't think there's much you can do other than contact your insurance, I doubt the cops will want to get involved since such small beans but I could be wrong.

You may need to file a report as a formality to claim this as a loss with your insurance. Could be one hell of a body shop bill as I see panel damage.

I'd be calling my insurance company for advice. Do they need an official police report, are pictures good enough, is there a chance you can have the other car owner's insurance pay for it and if so how do you go about it. Your company should know these things... And are the ones who will need to be satisfied if you end up SOL and paying for it.

Next time, take photos that show that the height of their damage lines up with yours. Take a photo of the paint transfer from yours to theirs and vice versa. Now you have proof. Leave a note telling them they obviously damaged your car and if they'd rather deal with just you and not the police and your insurance company, to give you a call. If you don't hear anything in a day, make a police report.

There lies the problem, most likely the police will not investigate as they are far to busy these days with other issues nor do they want to come out for things like this anymore.

Any CCTV on premises? Assigned parking?

Definitely call and get a police report. In my opinion this should be considered is a hit and run.

I don’t remember the name of the exact form. However, when I found damage to my car when parked in a 6 Flags parking lot, there was a form I had to file with the police department, and then I did a comprehensive insurance claim. The form more or less said, “ I found it damaged and I have no witnesses”. The police did not investigate or try to find anyone; they just filed the form.

I left a note on the person who parks beside me car because his car is damaged and you can Cleary tell he hit my car. He called me and claimed it wasn't him and how he never drove the whole day which is a lie

Just call the local PD and say someone hit your car on x day in x garage. Then get name and badge number. Give that to your insurance. If you have adequate insurance coverage they'll charge a deductible and fix your car through the local partnered shop. If you have a bad policy your premium will go up some amount.

It's not hard.

I know I was tryna a avoid making it go up more. I'm currently paying 650cad a month

It happened to me several months ago. Car was five months old at the time. We were in a comedy venue, and when we came back to the car, the rear bumper was pushed out and scratched down to the plastic. Cost me $500 deductible...

REALLY wish the cameras I paid BMW for would actually work while the car is parked.

Wow. Then you have no choice, I would file police report and do a small claims court to avoid insurance and try to get them to pay their damages. That said I never personally did that but to me that sounds like the way to go.

And only then if you cannot get money to fix your car that way, I would involve insurance.

And yes even with proof, if you make a claim and not at fault I'm pretty sure your rates still go up. IIRC mine did.

2nd this.. when the cop is there show him the pics of the car next to you with the paint transfer etc.. you’ll get a report either way and call ur insurance you’ll pay ur deductible and it’ll get fixed..
