ticketed for 100mph when I was really going 70ish in a 50
After a great night of going out with my homies, I was heading home at 3:30am driving on a 50mph highway. 5 minutes later I see christmas nights behind me. I pulled over and asked the officer why he pulled me over and he said I was darting down the highway at 100mph. Honestly, I was going no more than 70 mph. MOST BS MOTHEREFFIN ticket ever! He was going to arrest me but I talked to him in a friendly/non-intimidating way and informed him that my parents were worried sick at home waiting for me. Based on that he decided to let me go with a citation (non-misdemeanor) for going 100mph in a 50 mph zone, NO RADAR. Any suggestions on fighting this ticket? The thing is, I go to school in San Diego and this ticket was issued in the Bay Area (home for spring break). E90post OTers please shed some light on this. Thanks!

Admitting 20 over the speed limit is pretty egregious and I personally think you could have done worse as far as citations go.
I'd lick my wounds and walk away knowing that I could have gotten my car impounded and put in jail. *shrug* |

Talk to a lawyer and take it to the court. There are knowledgeable lawyers, who can help you and get the ticket dismissed or plea it down to a no-point violation, which helps you in the long run.

Trial by written declaration. I was accused of going 90mph (but wasn't). Fought it with written declaration and beat the ticket. Got fine reimbursed and ticket dropped...all while not even having to go to court. You say he didn't have radar, and if he paced you then I believe there should be a patrol car# on the ticket. If there is no indication on the ticket of how he claims you were speeding, then you should have a chance. I don't think he would've paced you, because IF you were going 100mph, you would've noticed another car behind you matching your speed (especially at night). Basically would've been a race LOL.
I have no legal experience, and I'm just a regular joe. I do not claim nor guarantee that this will work. Do some research and make your decision. Good luck |

If he wrote you up at 100mph, I think that is a "court appearance required" type of ticket and you loose the opportunity to do a Trail by declaration if that is the case.
I haven't gotten a 100+, but I have gotten 3 tickets this year, and the last one said "court appearance required" on the ticket, it said that if you HAVE to appear, you can NOT do a trial by declaration
