Insurance Claim Help

My girilfriend got into an accident Two Weeks ago and fortunately it wasnt her fault. The other driver was insured and here is where the nightmare begins. I called to make a claim with his company the next morning. They informed me I had to take the car to their body shop so they can appraise it. Unfortunately their soonest appointment was a week away. Keep in mind the car is not driveable because the driver door is stuck closed. A week goes by and I take the car to the body shop. After waiting an hour they finally take some pictures of the car and tell me they have to complete their investigation which will take between 30 and 60 days!! I leave and call the company to see if there is any way to expedite this process. The lady on the line has the balls to tell me "what are you calling for its only been fifteen days"

In short this insurance company sucks, my girlfriend is without a car and i dont see this being resolved anytime soon.

From what I see there a few options.

1. Wait 30-60 days
2. Sue the driver is small claims court
3. Have my lawyer write the driver a letter
4. Call one of these accident hotline lawyers you hear on the radio.
5. Fix the car out of pocket

Any insight or experience you guys can offer is appreciated.

First: That company is not top notch. This is why it's important to have a company like State Farm or USAA even if they are an extra $10/mo, etc.

Second: Just wait. 15 days is really not a large amount of time for a large accident. If you try taking them to court, it's going to be months away before you get a court date. if you hire an attorney, he's going to send them a letter and they'll have 30 days to respond AND will then be on the defensive with you, OR you can wait another 15 days. Unfortunately, this is how crappy insurance companies work.

I waited for 728 days before I got a single dime when a women flipped a U-turn into me. 100% her fault... 2 years of waiting. In many states, 2 years is the legal limit they have to make an offer.


FYI: I'm an insurance agent.


Edit: Depending on who you have as your own company, you can file a claim through them, pay a small deductible to get your car fixed, and your c ompany will go after the other, most likely getting your deductible back at some point. That may expedite the process if the other company takes too long. A month before repair is not long for many companies.

A line I use to my clients "Same price, but quality of companies means havign a check in your hands in 4-5 days opposed to 4-5 weeks"

why don't you file a claim with her insurance and let them go after the other person's insurance? that's another thing her insurance does.

Last time I got into an accident it was the other persons fault. I got a call the next day from the guys insurance company telling me to take it to where I feel comfortable, have the body shop call them, and it will be taken care of.

Did you get a police report?

when i got hit by this lady i called my insurance and my insurance called her insurance and took care of it...you pay a lot for YOUR insurance, put them to work...

My gf has progressive. The other driver has United Insurance. The cop who was on the scene even told my girlfriend "your gonna have to fight this one out, United is the worst" Boy was he right

I am trying to avoid calling her insurance company because she has already had two claims (her fault) within the last two years. Her insurance already expensive as hell and im trying to avoid having them raise the premium or at worst canceling her.

UPDATE

My GF just called and spoke with a "supervisor". The supervisor is saying that their cleint is saying he was not at fault and didnt agree with the tickets. Hence their investigation. He also said that after the 60 days chances are she may not even get her car fixed because the other driver is claiming that he didnt not fully understand the officer because he speaks only Spanish. BIGGEST BS EVER!!

you should really get your girlfriend's insurance on board in this case. they have attorneys that will sue for this stuff.

Based on the above, I would recommend the below:

Call Progressive first and explain to them what's going on and have them note your record so an underwriter doesn't try to cancel her at renewal. If the other company is already making excuses, it may be the start to a veeeeeery long, drawn out, rediculous process. Let companies fight it out. Since there is a police report filed, it will most likely only be a $300 deductible up front, with likliness of gaining it back.

I took everyones advice and contacted Progressive just to get their stance on the situation. The advised me they would fight the company with their lawyer and assured me her premium would not be raised if she was not at fault.


I went ahead and filed a claim, I should be dropping the car off Tuesday morning.I will have to pay a $500 deductible but they said it will probably be refunded once they purse the other company.

LOL @ the other guy claiming he doesn't get it because he doesn't speak English. You must be able to at least somewhat understand English to pass the written test for your license. F that shit. Learn it, love it, or get the fuck out.

alright let me give you some insight from a similar situation that happened with me.

Let them duke it out, but STAY ON TOP OF IT. If for whatever reason your agent decides to be lazy, it could be rolled to be at your fault (seen it). Check in every couple weeks, make sure you know the second they make a 'verdict'.

Good luck. Call every week or two and they will usually work on it harder. I had to do that when I got sideswiped. Got a manager one time after about 5 weeks of calling in and it was taken care of later that week. It is amazing how fast it can run when you talk to the right people!
