Just read the whole article. The guy who fell was conscious afterwards and telling EMS that his son was all by himself.

Thank you for posting this Collin. Saw it early this morning and was going to post about it. This is an absolutely tragic story. While on the stretcher,the man kept talking about his son being all alone. Just heart wrenching. Can't tell you how many ball games I went to with my dad as a kid. I know he would have done anything to get me a baseball if he could, just as this man tried to for his son.
Very very sad. Rest in peace.

The railing is way too low. OSHA requires a min of 3.5 feet for railing on maintenance platforms - and that's for "trained" personnel use. This type of application where it is expected that people would be leaning over for a baseball, it should be even higher.
By looking at the railing height compared to the people around it, I say it's at least 6 inches short of the minimum requirement. A lawsuit is definitely in order. |

^ Something is not right with the rail height for sure.
What is creepy is that last year almost to the day a man fell over out there. He survived. The creepy part is that he too was a fireman.

Aside from the fact I agree with you, when you buy and use a ticket to go to a sporting event, you are basically exempting the organization, park, and sponsors from personal injury liability. Though people still sue, and in order to keep these events as out of the media as possible, they usually settle.

The son is obviously the person that needs the most care and attention right now.
I would also be concerned about Josh. His past problems are well known and I hope he doesn't fall off the wagon over guilt he may feel for possibly short arming the toss to the victim.
