You kind of lost me there. Are you implying that an unsuccessful suit would raise awareness to people to NOT do stupid things?

Actually, I think the ballclub should just put some 5" (ok 2") pads below these areas. That way nobody would likely be seriously injured but would get a real wakeup call and the club would probably absolve themselves of most the liability even for folks who just kind of get caught up in the moment.

i'm saying events like this are the reason to sue. If a ballpark isn't adhering to safety guidelines, this is when you sue. Otherwise there is no responsiblity for their actions

in general no, lots of assholes suing for stupid things.

There are things out there in which lawsuits should be brought into the picture...as its the only way to ensure change is done,.

After looking at the video further, the railing actually look lower than I thought. It's below the waist line. It's definitely below 3 feet. I'm pretty sure the family will win this case regardless of any legal wavier imposed on the back of the ticket.

Normally I don't have anything wrong with trying to get compensation for negligence and I acknowledge that as this seems to be the second event (with probably similar safeguards in both cases). But, in a nation of 300+ million that attend sporting events in all manner of impaired judgement, I think there will always be someone that could potentially have an accident and it not be the 'fault' of anyone specific. And the likely solution on the part of some underwriter will probably include some type of barrier that would prevent someone from getting that close to the rail as opposed to raising the rail to some specific height that would be scaled by said impaired spectator and you still have the same problem but now with everyone being relegated to never having access to a foul ball again.

Should the family attempt to ensure the problem does not happen for some other father? Yep, and maybe them pushing for something that would minimize the chance of permanent injury is all I would personally strive for.

Should the family attempt to get some compensation? Well, I won't try to speak to that. I would not look down on them for it, but I personally think its trite and it would not be a option I consider.

But this kid does not have a father anymore. The bread winner in the household is no longer there. So you really expect the mother to now have to pay the mortgage on the house, utlities, insurances, taxes, etc. on her own? no, i say fuck no. This is why stadiums pay big bucks for insurance.

I hope they win their case, because im worried about the childs future. He should at least not have to worry about food, shelter, school and college.

From what I've read there is a rule for how high the rail must be, and it clearly isn't. My guess is they will settle out and keep it quiet, while making the necessary changes to the stadium to ensure this doesn't happen again.

The family deserves it, this could of happened to anyone at any given time with the rail situation, bear trap waiting for a victim. They could at least install safety nets at all 30 stadiums to stop this from happening anywhere else.

I agree, if there is a stated standard and this facility is inadequate then it should be addressed and these people should be compensated. But for that matter, shouldn't the guy who went over a year ago?

Me personally?, IM ChickenS and wouldn't even get near the edge. I handed a guy my camera when it came time to walk out on the goat trail at pikes peak bc I didn't want to appear on the front page of the denver post with the headline - ANOTHER TOURIST FALLS OFF the mountain.

That person fell off of the second deck, the rails were 30" which were 6" over the rule. Sad, but they weren't liable. If they can prove those railings yesterday were too short, settlement will ensue.

Hm.. so the standard for the upper deck is 24"? In looking at the vid, it appears that this rail is higher than 2'. Looks like its almost 3'.

If anything, I could see 2' being insufficient and 3' being adequate. It would be a tough sell for me on a jury... and again, I don't tend to favor big corps on something like this.

I could understand that 3' kind of strikes people at just below that center of gravity and it would be much more prone to loosing balance as you extend. That being the case, I would think it would at least have to be 42" if they are trying to truly prevent or address such a problem. Maybe it would not have to be like that all the way around. But either way, extending it to 3.5' will be very expensive for most of these facilities.

guy has been fighting fires for 15+ years and then dies suddenly from a freak fall.

i'm sure he would have preferred to die fighting a fire out of site's view from his child.
